Approved Liquidator
Definition
"Approved liquidator" means a person who has been approved under Section 433 as a liquidator and whose approval has not been revoked.
Practical Explanation
An approved liquidator is an individual who has been formally approved under Section 433 of the Companies Act 2016 to act as a liquidator in the winding up of companies in Malaysia.
Only a person whose approval remains valid and has not been revoked is legally authorised to act as an approved liquidator under the Companies Act 2016.
Key Responsibilities of an Approved Liquidator
An approved liquidator is generally responsible for:
- Taking control of the company's assets and records upon appointment.
- Realising and distributing the company's assets in accordance with the Companies Act 2016.
- Settling the company's debts and liabilities in the prescribed order of priority.
- Investigating the company's affairs where necessary.
- Reporting to creditors, contributories, and the relevant authorities as required by law.
- Ensuring that the winding-up process is conducted in accordance with the Companies Act 2016 and any applicable court orders.
Appointment
An approved liquidator may only act as a liquidator if he or she has obtained approval under Section 433 of the Companies Act 2016 and continues to hold a valid approval.
Compliance Note
If a liquidator's approval under Section 433 is revoked, suspended, or otherwise ceases to be valid, that person is no longer eligible to act as an approved liquidator under the Companies Act 2016.
