Procedural Rigor: The Signatory’s Responsibilities

Procedural Rigor: The Signatory’s Responsibilities

One of the most frequent reasons for appointment delays in legal firms is the client arriving unprepared for the "Personal Presence" rule. Legal standards under the Notaries Public Act 1959 are non-negotiable: the Notary must physically see the person sign the document

Identification: You must produce an original NRIC (for Malaysians) or a valid Passport (for foreigners). Digital copies or photocopies of IDs are never accepted.

The "No Pre-Signing" Rule: Documents must be signed in front of the Notary. If you have already signed the document at home, the Notary will likely ask you to reprint it and sign it again in their presence to maintain the integrity of the attestation.
