A caveat is a legal notice lodged at the Land Office that prevents a property from being sold or transferred without your consent. It protects your interest when there is a legal or financial relationship with the property.
We assist clients in lodging, maintaining, defending or removing caveats throughout Malaysia.
A private caveat (Form 19B) is registered to protect your claim or interest, such as:
• You signed an SPA
• You loaned money and property is collateral
• You invested in property development
• You are a beneficiary in disputed estate
• You are involved in a property dispute
• You fear the owner may transfer the property
We ensure correct grounds exist to avoid removal challenges.
We prepare Form 19G & required documents.
If the landowner or developer attempts to remove it.
We identify all encumbrances on the title.
Including misuse, fraudulent lodging or malicious caveats.
You should lodge a caveat if:
• You are buying auction property
• You invested money in a property project
• You hold beneficial ownership
• You are concerned owner may sell illegally
• You are entitled to property in inheritance disputes
Remove the caveat when:
• A transaction is completed
• Mortgage/charge is registered
• The claim is resolved
• Caveat was lodged wrongfully
