If you become a victim of online defamation, you may initiate legal proceedings against the person who published false statements.

To bring an action for online defamation in Malaysia, you must prove the following elements:

1. False Statement
The statement must be fabricated or untrue.

2. Reference to the Plaintiff
The statement must clearly refer to you or your company.

3. Publication to a Third Party
The statement must have been published and disseminated to third parties via websites or social media platforms (such as Facebook, Instagram, LinkedIn, X (Twitter), WhatsApp, etc.).

4. Damage
The statement must have caused harm to your or your company’s reputation, or resulted in some form of financial loss.

5. Malice
The person publishing the false statement must have acted with intent to harm your reputation or with reckless disregard for the truth.
